Eagle Pass Heliskiing Ltd. General Business Terms and Conditions

Management/Organizer

Eagle Pass Heliskiing Ltd. (EPH) is the organizer of the ski packages described throughout the EPH brochure and website.  Any travel agent or individual representing EPH is acting only as an agent authorized for encashment.   

Note: the term Heliskiing shall include heli snowboarding, heli telemark skiing and heli access ski touring skiing. 

Registration Policies and Conditions

By submitting a signed Payment Authorization Form and/or Registration Form the guest has agreed to a legally binding agreement with Eagle Pass Heliskiing Ltd. as outlined in the policies and conditions below.  

Payment details are outlined on the EPH Payment Authorization form. EPH accepts Visa, Mastercard, American Express, Bank Transfers, cheques, and Interact Email Money Transfers (Interact Transfers only available for Canadian guests and are limited to $3,000 CAD per transaction).

Deposits, Registration and Payment

It is essential that each guest familiarize themselves with the terms and conditions and the information below as well as on the EPH website.  This will ensure they choose the best package for their needs, have a full understanding of what their Heliskiing package includes and are fully aware of EPH’s policies in regard to cancellations and refunds.

Deposit Required – All Programs

Heliski packages are booked directly through the EPH office.  A non-refundable deposit and completed registration form are required upon booking to confirm the reservation for all Heliski packages.  The deposits for all of the packages are 30% of the after-tax package price. All rates are in Canadian dollars (CAD) and are subject to change without notice. 

Final Payments – All Programs

Final payment is required on October 1st for all programs.  If booking is made after October 1st, the full payment is due upon booking.  All rates are in Canadian dollars (CAD) and are subject to change without notice.  A 5% Goods & Services Tax (GST) is not included in any of the ski package prices.   For lodge bookings, a $8 per day Provincial Sales Tax (PST) is not included in any of the ski package prices. 

Guest Responsibility

Guests are responsible for familiarizing themselves with EPH Terms and Conditions before booking their Heliski package. It is also the guests’ responsibility to fully understand their package – what is included, and what is not included.

For guests travelling from outside Canada a Valid Passport and/or Travel Visa is required to enter Canada. Refunds will not be given to guests that are denied admission into Canada.

Guests are responsible for being on time and prepared to ski on their specified Heliski day(s). Arriving late or ill equipped may result in a guest missing their Heliski day(s) in part or in whole. Refunds will not be given to guests that arrive late or ill equipped.

Trip Cancellation Insurance is strongly recommended to guests for any unforeseen circumstances that may interrupt or cancel their Heliski trip. Refer to the Trip Cancellation Insurance section below. 

Ability

Eagle Pass requires that all guests are able to ski at an advanced level (black diamond runs). Guests must be experienced skiing ALL types of terrain in DEEP POWDER conditions (knee deep+) – trees, glades, steeps, chutes, and variable snow conditions. Eagle Pass Heliski does not have any intermediate terrain. Previous Heli, Cat or Ski Touring experience is mandatory.  

Heliskiing is a demanding physical activity. It is recommended that guests assess their own fitness level well in advance and prepare themselves accordingly – through on-slope skiing or by undertaking a regular fitness routine. Refunds will not be given to guests that are unable to competently Heliski due to lack of physical fitness, skill level, or experience.  If a guest cannot complete their day due to fitness level or ability, they may be asked to wait in a safe area in the backcountry until lunch is served, or for the remainder of the day.  

While we try our best to group skiers and boarders by ability level, this is based on each individual’s perception of their own abilities.  Until we have Heliskied with each guest, it is impossible to assess a guest’s true ability.  While we can always accommodate a single guest, we require them to have previous backcountry experience.  It is HIGHLY RECOMMENDED to book as a group of 4 to ensure that everyone skis/boards at the same level.

Minor Guest Policy

At Eagle Pass Heliskiing Ltd. we welcome any guests under the age of 19 as Heliskiing should be enjoyed by all ages.  If any guest under the age of 19 wish to join us, there are a few guidelines that must be followed: 

  • Minor guests are only allowed if they are booked as a complete group of 4, with one parent or legal guardian accompanying them throughout the day.  
  • The minor must be 12 years old or older when Heliskiing and has the physical ability to go Heliskiing.  Please see ability section for further information.
  • Two waivers must be signed in the morning in order to go Heliskiing.  One waiver signed by the legal guardian, and one waiver signed by the minor dated for the day they become of legal age
  • Only the parent or legal guardian can accompany the minor throughout the day and sign the waiver on behalf of the minor guest.  This responsibility cannot be shared, nor can a different guardian be appointed for the day    
  • If the legal guardian needs to stop Heliskiing at any time of the day due to fitness, equipment failure, or ability, the minor guest cannot continue Heliskiing.  The legal guardian needs to be in the field with the minor at all times

Private Heliskiing Terms and Conditions

At Eagle Pass our Private Heliskiing program is based on helicopter flight hours. There are significant costs and specific Terms and Conditions associated with reserving a helicopter for Private use.  It is essential that each guest familiarize themselves with all of EPH’s General Terms and Conditions including the following:

  • Each Private Heliskiing reservation, regardless of group numbers or size, is chartering a private helicopter for a pre-determined number of days, on specific dates. Private Heliski clients are responsible for a multi-hour flight minimum per day depending on group size. This multi-hour minimum per day is cumulative for the duration of the trip. In addition to this, each group up to 4 guests requires their own Guide and is responsible for the associated Guide Service Fees.
  • For Private Heliskiing reservations that consist of a single group, two guides will be booked for this group, limiting the guest group size to 3.
  • All Private Heliskiing reservations, regardless of group size or trip duration, are subject to a Group Administration Fee.
  • In most cases, Private Heliskiing groups will fly more than their multi-hour flight minimum per day. The Lead Guide for the group will inform the guests when they are approaching their multi-hour flight minimum each day. It will be the group’s decision whether or not to continue Heliskiing over and above this minimum
  • At the conclusion of every Private Heliskiing package the total flight time is calculated. If it exceeds the cumulative pre-booked multi-hour flight minimum per day, then a final invoice will be presented for the overage.

Refund and Cancellation Policy

There are a few circumstances that may force EPH to cancel a Heliski day, in part or in whole: Inclement weather, avalanche conditions, operational emergencies, mechanical reasons, or guest booking minimums not met for your day. In the event that Eagle Pass must cancel a day, guests will be given the option to rebook for the next available day, or will be offered a credit or refund, depending on the circumstance and the product that they purchased.

Heliskiing is a unique experience that is highly subject to weather & snowpack conditions. These conditions are constantly changing and add an element of complexity to each Heliski day.

Refund and Cancellation Policy – Day Heliski Program

At Eagle Pass our Day Heliskiing program is based on runs skied rather than vertical skied. We have recently revised our Minimum Guarantee/Refund Policy to reflect this:

  • We guarantee each guest will be given the opportunity to Heliski at least 6 runs per day. A standard Day Heliski package averages 6-8 runs per day.
  • Refunds will not be offered to guests who are unable to Heliski at least 6 runs per day due to late arrival, early departure, physical fitness, ability level or injury.
  • If Eagle Pass cancels a Heliski day before the scheduled start time the guest will be given the opportunity to rebook for the next available date or a later date that season. If they are unable to rebook a full refund will be given.
  • If Eagle Pass cancels a Heliski day once registration, rental allocation and safety training has been completed then guests will be given the opportunity to rebook for the next available date or a later date that season. If they are unable to rebook a full refund will be given, less a $25 Administration fee

If a Heliski day commences and Eagle Pass is unable to deliver the guaranteed minimum 6 runs due to the aforementioned circumstances, then a refund will be offered based on the following:

Refund and Cancellation Policy – Lodge Program

At Eagle Pass our Lodge Heliskiing program is based on vertical skied. We have recently revised our Minimum Guarantee/Refund Policy to reflect this:

  • We guarantee each guest will be given the opportunity to Heliski an average of at least 3,000 meters per day. This daily guarantee is cumulative for the duration of their trip. 
  • Refunds will not be offered to guests who are unable to Heliski at least 3,000 meters per day due to late arrival, early departure, physical fitness, ability level or injury.
  • If EPH cancels a guest’s Heliski package before the guest’s scheduled arrival date the guest will be given the opportunity to rebook for the next available date or a later date that season. If they are unable to rebook, a full refund will be given.
  • If Eagle Pass cancels a Heliski day once the guest arrives at the Lodge, then the guest will receive a $1, 485 refund plus 5% tax (Single Day Heliskiing Rate). The guest’s guaranteed meters for their package will also be reduced by 3,000 meters to adjust for the down day. This refund can be applied toward a future booking, however, cannot be used to cover incidentals during the guest’s stay (liquor/wine/beer and retail purchases).
  • At the end of a guest’s package, the total vertical skied will be calculated. If the total vertical skied is less than 3,000 meters per day then the guest is entitled to a refund at the rate of $139 per 1,000 meters. This refund can be applied to a future booking, however, cannot be used to cover incidentals during the guest’s stay (liquor/wine/beer and retail purchases).

Refund and Cancellation Policy – Private Heliski Program

At Eagle Pass our Private Heliskiing program is based on hours flown rather than vertical skied. We have recently revised our Refund Policy to reflect this:

  • If EPH cancels a Private Heliski package before the guests scheduled arrival date the guest will be given the opportunity to rebook for the next available date or a later date that season. If they are unable to rebook a full refund will be given.
  • If Eagle Pass cancels a Private Heliski day due to weather, mechanical breakdown, or avalanche conditions we offer guests the chance to apply these ‘down day’ flight hours to the rest of their trip. If these hours are not used by the end of the trip, a refund will be offered to the guest. The Administration Fee and Guide Service Fees are non-refundable.
  • Refunds will not be offered to Private Heliskiing guests who are unable to fly their pre-booked multi-hour flight minimum per day due to late arrival, early departure, physical fitness, ability level or injury.

Guest Cancellation 

All ski packages start and finish on the specified dates and have been offered as a complete package.  There are no refunds, partial or full for any of the following reasons: late arrival or early departure for any reason, sickness or injury, or lack of skier ability or fitness.

Cancellations must be made in writing and received by email.  Time of cancellation is established upon at time of email response from EPH back to guest. It is the guest’s responsibility to follow up via phone call to ensure email has been received if no response has been received after 36 hours. 

Cancellation prior to the full payment date identified above will result in loss of the non-refundable deposit.  If cancellation is received after the full payment date identified above, then no refund is owed by EPH.

If a Guest cancels their trip prior to commencement, then their Heliski package is transferable to a new Guest for the exact dates and duration.  If the Guest is unable to find a replacement EPH will attempt to resell the package on the Guests behalf, in accordance with the following terms:

  • EPH will try to resell the package for full price.
  • A Resale Fee of $100 CAD per seat resold or 5% of the total package price will be applied, at the discretion of EPH.
  • A refund will only be granted if the package is successfully resold. If EPH is unsuccessful in reselling the package no refund will be given.

If Trip Cancellation insurance is not purchased, and EPH cannot find a paying guest to replace your space, EPH reserves the right to fill this space with a staff member or partner of EPH’s.  In this case, no refund is awarded, nor can your space be deferred to the following season.  Trip Cancellation Insurance is HIGHLY RECOMMENDED.

EPH reserves the right to cancel any Heliskiing package at any time.  Should this occur, a full refund of payments including deposit will be given. 

Trip Insurance

Emergency Medical Coverage 

Eagle Pass Heliski will provide Emergency Medical Coverage including Ambulance/Evacuation insurance as part of your package purchase. All claims require you seeing a physician.  

Trip Cancellation Insurance 

We understand that occasionally events occur that prevent you from joining us for your ski vacation.  Please pay special attention to our Cancellation and Refunds Terms. 

To avoid any financial hardship that an unexpected cancellation or interruption could cause, we strongly recommend purchasing Trip Cancellation/Interruption to protect your trip investment.

In the event that a guest cancel’s their trip and starts a claim through Trip Cancellation Insurance, either through EPH’s preferred insurer or any other Insurance agent the guest may have, EPH reserves the right to either resell this seat or fill this seat with a staff member or partner of EPH’s.  In the case of both events, no reimbursement to the guest will be awarded.
